By ordering any of our products, you agree to be bound by these Terms & Conditions.
By placing an order at VIVAGO, you warrant that you are at least 18 years old or have a parent’s/guardian’s permission to buy from us.
All personal information you provide us with or that we obtain will be handled by GYML BRANDS LLC as responsible for the personal information.
Events outside VIVAGO’s control shall be considered force majeure.
The price applicable is that set at the date on which you place your order.
Shipping costs and payment fees are recognized before confirming the purchase.
Card information is transmitted over secure SSL encryption and is not stored.
Please note that local charges may occur, including without limitation for shipments outside the U.S.
VIVAGO reserves the right to amend any information without prior notice.

This page contains the terms & conditions (“Terms”) from GYML BRANDS LLC (“VIVAGO,” “we,” or “our”) regarding your use of our website (found at www.vivago-us.com, “Site”), your purchase of our products (“Products”), or your participation with and access to our SMS services (collectively, the “Services”). By using the Site, ordering any of our Products, or receiving Services, you agree to be bound by these Terms.
1. Eligibility & Agreement
By placing an order through the Site, you represent and warrant that you are at least 18 years old (or have parental/guardian permission) and accept these Terms, which apply to all orders placed for the sale and supply of Products. None of these Terms affect your statutory rights. We may update or amend these Terms at any time by posting changes on the Site.
2. Restrictions
You agree not to:

- Reproduce, modify, or create derivative works of the Services.

3. Payment
All Products remain VIVAGO’s property until full payment is received.
Prices are those in effect at the time of order.
Payments are processed via third-party secure gateways (e.g., Stripe, PayPal). We do not store card information; all transactions are SSL encrypted. Please check your payment provider’s terms.
4. Products
We aim to describe Products accurately but do not guarantee that descriptions, images, or specifications are error-free. Availability is not guaranteed, and we may discontinue Products at any time. Prices may change without notice. We may cancel orders and refund you if necessary.
5. SMS/Text Messaging Services
By opting in, you agree to receive recurring SMS/text messages (order updates, promotions) to the mobile number provided. Standard message/data rates apply.

6. Shipping
VIVAGO determines the shipping method. Delivery times are estimates only. You are responsible for providing accurate shipping details. We are not liable for delays or losses caused by incorrect addresses.
7. Return Policy
We warrant that Products meet their description. If they do not, your sole remedy is an exchange or refund within 30 days, provided the item is unused, in original packaging, and with all tags.
Refunds exclude original and return shipping costs.
Items purchased via third parties (e.g., Amazon, TikTok) must be returned through that seller.

8. Personal Information
We handle your personal data in accordance with our Privacy Policy. Your data is used for order fulfillment, account management, and marketing (if you’ve opted in). You have the right to access, correct, or delete your data by contacting us.

EXCEPT AS EXPRESSLY SET OUT IN THESE TERMS, VIVAGO DISCLAIMS ALL OTHER WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted, error-free, or secure access to our Site.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVAGO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. Our total liability shall not exceed the amount you paid for the Products or $100, whichever is greater.
16. Dispute Resolution
Any dispute shall first be attempted to be resolved directly. If unresolved within 60 days, disputes will be submitted to binding arbitration in New York, NY, administered by JAMS. You waive the right to jury trial and to participate in class actions.
17. General
Failure to enforce any provision is not a waiver. Headings are for reference only. These Terms are the entire agreement regarding your use of the Site and purchase of Products.
18. Additional Information
We may amend product info, prices, or availability without notice. If a Product is sold out, we may cancel the order and refund you.
